Adelaide’s Long Lunch Second Chance Draw

1. RECITALS

1.1. The Adelaide Economic Development Agency (AEDA) (ABN: 76 182 348 392), a subsidiary of the Corporation of the City of Adelaide (ABN: 20 903 762 572), conducted a major trade promotion lottery known as “Adelaide’s Long Lunch Promotion” pursuant to SA Licence No T21/137 (the Original Promotion).

1.2. Five thousand entrants of the Original Promotion were granted a prize in the Original Promotion, namely one of 4,000 lunch vouchers valued at $30 or one of 1,000 experience vouchers valued at $30 each, which can be redeemed at participating businesses.

1.3. When entering the Original Promotion, each entrant agreed to have their personal details recorded and to receive further promotional emails from AEDA. Participants may unsubscribe from these emails at any time.

1.4. AEDA has determined that it will grant prizes to an additional 20,000 entrants of the Original Promotion, by way of a “Second Chance Draw”. These prizes will be 16,000 lunch vouchers valued at $30 and 4,000 experience vouchers valued at $30 each, which can be redeemed at participating businesses.

1.5. These terms and conditions govern the “Second Chance Draw” (the Second Promotion).

2. ENTRANTS IN THE SECOND PROMOTION

2.1. All entrants of the Original Promotion are entrants in the Second Promotion, excluding persons belonging to any of the following categories:

2.1.1. Persons who won any prize in the Original Promotion;

2.1.2 Persons who have unsubscribed from promotional emails from AEDA since entering the Original Promotion;

2.1.3. Persons who provided to AEDA in connection with the Original Promotion an email address which, at the time of the Second Promotion, is non-existent or is otherwise an email address to which AEDA’s email system is unable to deliver an email containing a prize voucher on the first attempt (regardless of whether this inability is due to AEDA’s email system, the person’s email system, or any other reason).

2.2. No new entrants will be permitted.

3. TIME AND DURATION OF SECOND PROMOTION

Primary Draw

3.1. Twenty thousand email addresses will be drawn (Primary Draw in the Second Promotion) from the pool of email addresses which the entrants in the Second Promotion provided when they entered the Original Promotion. Sixteen thousand of these will be drawn from those who nominated to receive a lunch voucher and 4,000 will be drawn from those who nominated to receive an experience voucher.

3.2. The Primary Draw in the Second Promotion will drawn on 3 May 2021 at 10:00 am ACST.

3.3. The Primary Draw in the Second Promotion will take place at the City of Adelaide Customer Centre located at 25 Pirie Street, Adelaide SA 5000.

3.4. The 20,000 email addresses drawn in the Primary Draw in the Second Promotion will be selected using a random electronic drawing process which is the same or substantially the same as the random electronic drawing process used in the Original Promotion.

3.5. An independent scrutineer will be present at the time of, and for the duration of, the Primary Draw in the Second Promotion.

3.6. Prize vouchers will be emailed to each of the 20,000 email addresses drawn in the Primary Draw in the Second Promotion by 5.00pm on 4 May 2020.

Supplementary Draws

3.7. If AEDA receives one or more notifications that a prize voucher sent pursuant clause 3.7 cannot be delivered to an email address, supplementary draws will occur in accordance with the below provisions and consistent with the below example to ensure that all 20,000 prize vouchers are delivered to unique entrants.

3.7.1. Example—

3.7.1.1.  If, following the sending of prize vouchers pursuant to clause 3.7, AEDA receives 150 notifications that an email containing a prize voucher cannot be delivered to an email address (irrespective of the type of voucher – being a lunch or experience voucher), a first supplementary draw will occur (excluding winners from the Primary Draw) to draw the winners of the 150 vouchers (divided according to type of voucher sought) which have not been delivered to any entrant.

3.7.1.2. If, following the sending of prize vouchers after the first supplementary draw, AEDA receives 10 notifications that an email containing a prize voucher cannot be delivered to an email address, a second supplementary draw will occur (excluding winners from the Primary Draw and the first supplementary draw) to draw the winners of the 10 vouchers which have not been delivered to any entrant.

3.7.1.3. If, following the sending of prize vouchers after the second supplementary draw, AEDA receives 1 notification that an email containing a prize voucher (of the relevant type) cannot be delivered to an email address, a third supplementary draw will occur (excluding winners from the Primary Draw and the first and second supplementary draws) to draw the winner of the 1 voucher of that type which has not been delivered to any entrant.

2.7.2. To avoid doubt—

3.7.2.1. When AEDA receives a notification that an email containing a prize voucher cannot be delivered to an email address, the person who provided that email address is not a prize winner, as they are not an entrant in the Second Promotion whatsoever (in accordance with the operation of clause 2.1.3). No attempts will be made to contact any such person.

3.7.2.2. An ‘out of office’ email or other similar automatic reply generated upon delivery of an email containing a prize voucher to an email address does not constitute notification that the email containing the prize voucher cannot be delivered to the email address. The email will be deemed to have been delivered and the prize voucher will be deemed to have been claimed.

3.8. The first supplementary draw (if required) will be drawn on 5 May 2021 at 10:00 am ACST. Emails containing prize vouchers will then be emailed to each of the email addresses drawn in the first supplementary draw, as soon as practicable.

3.9. The second supplementary draw (if required) will be drawn on 5 May 2021 at 12:00 pm ACST. Emails containing prize vouchers will then be emailed to each of the email addresses drawn in the second supplementary draw, as soon as practicable.

3.10. The third supplementary draw (if required) will be drawn on 5 May 2021 at 2:00 pm ACST. Emails containing prize vouchers will then be emailed to each of the email addresses drawn in the third supplementary draw, as soon as practicable.

3.11. Further supplementary draws (if required) will occur every two hours in accordance with the pattern set out in clauses 3.9 to 3.11, until all 20,000 prize vouchers are delivered to entrants.

3.12. The supplementary draws (if required) will each take place at the City of Adelaide Customer Centre located at 25 Pirie Street, Adelaide SA 5000.

3.13. The email addresses drawn in any supplementary draws will be selected using a random electronic drawing process which is the same or substantially the same as the random electronic drawing process used in the Primary Draw in the Second Promotion.

3.14. An independent scrutineer will be present at the time of, and for the duration of, any supplementary draws.

3.15. AEDA may, following consultation with the independent scrutineer, alter the times of any supplementary draws for any reason.

3.16. The duration of the Second Promotion is the period commencing upon the Primary Draw in Second Promotion and concluding upon the last of the 20,000 prize vouchers being delivered to an entrant.

4. THE PRIZE

4.1. The prize to be won in the Second Promotion is one of 16,000 lunch vouchers or one of 4,000 experience vouchers, delivered by email, valued at $30 each. The total prize pool is valued at $600,000.

4.2. Once an email containing a prize voucher is delivered to an email address, it is deemed to have been claimed.

4.3. The prize vouchers may be redeemed at participating businesses within the City of Adelaide, including North Adelaide, at any time from the date of the Second Draw until 30 June 2021, or until such other date as AEDA may advise.

4.4. A list of participating lunch and experience locations is available at experienceadelaide.com.au.

4.5. The list of participating locations may change at any time.

4.6. Each participating business reserves the right to refuse to redeem the prize vouchers on certain days or during certain time periods.

4.7. Each participating business also reserves the right to stipulate their own date to cease redeeming prize vouchers. This date may change at any time at the participating business’s discretion.

4.8. Prize vouchers are transferable.

5. CONDITIONS ON PRIZE VOUCHERS

5.1. Prize vouchers are not redeemable for cash and are valid for one use only.

5.2. A lunch prize voucher may not be redeemed at a participating experience location and an experience prize voucher may not be redeemed at a participating lunch location.

5.3. Lunch prize vouchers can be redeemed for dine-in food only, up to the value of $30. Lunch prize vouchers are not valid for:

• takeaway food;
• alcohol; or
• other beverages.

5.4. If a prize winner uses their voucher to redeem a lunch or experience of a value less than $30, any residual value in the prize voucher is forfeited and the prize voucher cannot be used on a further occasion(s).

5.5. No compensation will be payable to a prize winner if they are unable to use any element of the prize voucher as stated in these terms and conditions. Any part of the prize that is not redeemed is forfeited.

6. MISCELLANEOUS

6.1. A list of the winning entrants’ email addresses will be displayed at the City of Adelaide Customer Centre at 25 Pirie Street, Adelaide SA 5000 for a period of 7 days following the draw, except in the case of any entrant who notifies AEDA of their objection to the display of their email address.

6.2. AEDA’s decision in relation to any aspect of the Second Promotion is final. AEDA will not enter into any correspondence with entrants regarding the result of the Second Promotion.

6.3. The Second Promotion is in no way sponsored, endorsed, administered by or associated with Facebook. All entrants release Facebook of any liability with regards to the Second Promotion.

6.4. AEDA makes no representation, expressly or implied, as to the quality, reliability or suitability of the prizes and expressly disclaims any liability. Any problems associated with the prizes should be brought to the attention of the respective supplier of the lunch or experience.

6.5. If this competition is interfered with in any way, or is not capable of being conducted as anticipated due to any reason beyond the control of AEDA, including but not limited to technical difficulties, unauthorised intervention or fraud, AEDA reserves the right, in its sole discretion and to the extent permitted by law, to:

6.5.1. Disqualify any entrant from the Second Promotion; or

6.5.2. Modify, suspend, terminate or cancel the Second Promotion as appropriate and subject to any approval or directions from a regulatory authority.

6.6. The laws of South Australia apply to the Second Promotion. Participants submit to the exclusive jurisdiction of the laws of South Australia.
